1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Sia Makerlab ("Company," "we," "us") regarding your use of the Modulang Translator application (the "App" or "Service").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any modifications constitutes acceptance of the updated Terms.

2. Service Description

Modulang Translator is an Android translation application that provides:

• Text translation for 57 languages (powered by Modulang API)
• Text-to-speech (TTS) - Android built-in TTS and Azure TTS
• Speech-to-text (STT) - Android speech recognition
• Image translation - Text extraction and translation via ML Kit OCR
• Translation history storage and search
• 3 translation UI modes (Standard, Face-to-Face, Chat)
• 8 themes and font customization
• Optional ad-free experience through in-app purchase

The App is available on Android 8.0 (API 26) and above.

3. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement.

If you are not of legal age in your jurisdiction, you must have permission from a parent or legal guardian to use the App.

4. Usage Limits

4.1 Daily Translation Limit

Free users are subject to a daily limit of 50 translations. The limit resets daily at UTC 00:00 (or local midnight).

4.2 Character Limit

Each translation request is limited to a maximum of 200 characters.

4.3 Azure TTS Limit

Azure TTS is provided within the monthly free quota of 500,000 characters. When the quota is exhausted, only Android default TTS will be available.

5. License Grant and Restrictions

5.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on compatible devices you own or control, for personal, non-commercial purposes only.

5.2 Restrictions

You agree not to:

• Copy, modify, or distribute the App or any portion thereof
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal, harmful, or unauthorized purpose
• Use the App to infringe on the rights of others
• Sell, rent, lease, loan, sublicense, or otherwise transfer the App to any third party
• Use the App to transmit malware, viruses, or other malicious code
• Attempt to bypass the API or circumvent daily usage limits
• Attempt bulk translation requests through automated methods

6. Intellectual Property

6.1 Company Ownership

The App, including all content, features, design, text, graphics, logos, icons, images, and software, is owned by Sia Makerlab and is protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain rights to translation results you generate using the App ("User Content"). We do not claim ownership of your User Content.

You are solely responsible for the use of translation results and the consequences thereof.

7. Translation Service

7.1 Translation Accuracy

Translations are provided based on an AI model (TranslateGemma WMT24++). We do not guarantee the accuracy, completeness, or fitness for a particular purpose of translations.

7.2 User Responsibility

• Professional translator review is recommended for important documents
• Translation results for specialized fields such as law, medicine, and finance should be used for reference only
• We are not responsible for misunderstandings or damages resulting from translation results

8. Voice Features (STT/TTS)

8.1 Third-Party Engines

• Speech-to-text (STT) uses Android's built-in speech recognition engine
• Text-to-speech (TTS) uses Android's built-in TTS or Azure Cognitive Services

8.2 Voice Features Disclaimer

We make no warranties regarding:

• Accuracy of speech recognition
• Quality or availability of TTS output
• TTS support for specific languages
• Compatibility of voice features with your device

9. Image Translation

9.1 OCR Engine

Image translation uses Google ML Kit Text Recognition to extract text.

9.2 Disclaimer

• OCR accuracy may vary depending on image quality, font, and language
• We do not guarantee the accuracy of extracted text

10. In-App Purchases

10.1 Ad Removal Purchase

The App offers an optional in-app purchase to remove advertisements. This purchase is processed through Google Play.

10.2 Refunds

Refund requests must be submitted directly according to Google Play's refund policy. We cannot process refunds directly.

11. Advertising

11.1 Third-Party Advertising

The free version of the App displays banner advertisements provided by Google AdMob at the bottom of all screens. These advertisements are subject to Google's advertising policies.

11.2 Advertising Disclaimer

We are not responsible for the content, accuracy, or appropriateness of advertisements.

12. Disclaimer of Warranties

12.1 "As Is" Provision

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy or completeness of translations

12.2 No Warranty

We do not warrant that:

• The App will meet your specific requirements
• The App will be available at all times or in all locations
• The App will be free of errors, bugs, or security vulnerabilities
• Translations will always be accurate
• TTS/STT will work for all languages

12.3 Third-Party Services

We are not responsible for third-party services, including but not limited to:

• Azure Cognitive Services (TTS)
• Google ML Kit (OCR)
• Google AdMob (Advertising)
• Google Play (App Store, Payments)

13. Limitation of Liability

13.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIA MAKERLAB BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible assets
• Any damages arising from:
  • Your use or inability to use the App
  • Inaccuracy or errors in translations
  • Unauthorized access to or alteration of your data
  • Content or conduct of any third party
  • Errors, mistakes, or inaccuracies in the App

13.2 Liability Cap

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR TEN U.S. DOLLARS ($10).

14. Indemnification

You agree to indemnify, defend, and hold harmless Sia Makerlab from and against all claims, liabilities, and damages arising from or related to:

• Your breach of these Terms
• Your use of the App
• Your use of translation results
• Your infringement of third-party rights

15. Termination

15.1 Your Right to Terminate

You may terminate your use of the App at any time by uninstalling the App from your device.

15.2 Our Right to Terminate

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including breach of these Terms.

15.3 Effect of Termination

Upon termination:

• All licenses granted to you will immediately terminate
• You must cease all use of the App
• Locally stored data (history, cache) will be deleted upon app uninstallation

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

16.2 Jurisdiction

Any disputes arising from or related to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in the Republic of Korea.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17.3 Language

These Terms are provided in English. If translated versions are provided, the English version shall prevail in case of any discrepancy.
