1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Sia Makerlab ("Company," "we," "us," or "our") regarding your use of the Mindraw mobile application ("App" or "Service").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.

2. Description of Service

Mindraw is an offline-first mind mapping app for Android. It provides the following features:

• Local-first creation and editing of mind maps on a zoomable canvas with multiple layouts
• Rich node editing (title, note, color, progress, icon, image) and structure operations including reorder, duplicate, re-parent, multi-select, copy/cut/paste subtrees, collapse/expand, and undo/redo
• Home screen with search, templates, JSON import, trash, and document management
• Export to PNG, Markdown, Outline, and JSON
• Light and dark themes

The App is provided for Android devices only. Your mind maps are stored locally on your device.

3. Eligibility and Use Requirements

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement.

4. User Content and Backups

You retain all rights to the mind maps, notes, and images you create or import ("User Content"). User Content is stored locally on your device; we do not access, collect, or store it. You are solely responsible for your User Content and for keeping backups. Because data is stored only on your device, clearing app data or uninstalling the App will permanently delete your maps. We recommend exporting important maps (for example, as JSON) to back them up.

5. License Grant and Restrictions

5.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a compatible device that you own or control, solely for your personal, non-commercial purposes.

5.2 Restrictions

You agree NOT to:

• Copy, modify, or distribute the App or any portion thereof
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal, harmful, or unauthorized purpose
• Sell, rent, lease, or sublicense the App to third parties
• Use automated means to access or use the App without our express permission

6. Intellectual Property Rights

The App, including all content, features, functionality, design, and software, is owned by Sia Makerlab and is protected by copyright, trademark, and other intellectual property laws. Your User Content remains yours.

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without any obligation to you.

7. Advertising

The free version of the App displays advertisements through Google AdMob. Advertisements are subject to Google's terms and policies. You may remove advertising by purchasing the Pro upgrade described in Section 8.

8. In-App Purchases and Subscriptions

The App offers an optional Pro upgrade (an in-app purchase or subscription) to remove advertisements and unlock premium features. The following terms apply:

• All purchases are sold and processed entirely by Google Play and are subject to Google Play's terms and refund policies.
• Payment is charged to your Google account at confirmation of purchase.
• If the Pro upgrade is offered as an auto-renewing subscription, it renews automatically for the chosen period unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel a subscription at any time in Google Play > Subscriptions. Cancellation takes effect at the end of the current billing period.
• Purchases are non-transferable and tied to your Google account.

We are not responsible for any disputes arising from purchases processed by Google Play, and we do not receive or store your payment information.

9. Disclaimers and Limitation of Liability

9.1 General Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIA MAKERLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your use of the App at any time by uninstalling it from your device. Uninstalling the App does not automatically cancel an active subscription; manage subscriptions through Google Play.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms and, for material changes, displaying a notice within the App. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. For users in the European Union, these Terms shall be interpreted in accordance with applicable EU law.

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the Republic of Korea.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sia Makerlab regarding your use of the App.

This Terms of Service is available in English. If translated versions are provided, the English version shall prevail in case of any discrepancy.
