These Terms of Service ("Terms") constitute a legally binding agreement between you and Sia Makerlab ("Company," "we," "us," or "our") regarding your use of the CueVision mobile application ("App" or "Service").
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
CueVision analyzes a photo of a billiards table to suggest a recommended shot. Based on the image you provide, it shows a recommended path, aim point, tip placement, stroke strength, and difficulty, and plays back a simulation animation.
The App provides the following features:
Photos are processed on your device. The App is provided for Android devices only.
Shot analysis, recommended paths, and simulations are visual estimates intended to help you understand and practice a shot. They do not guarantee physical accuracy or any particular result on a real table, and should be treated as a practice aid and entertainment, not as instruction guaranteed to succeed.
You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent that you meet this requirement.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on a device you own or control for your personal, non-commercial purposes. You agree not to copy, modify, distribute, reverse engineer, or sublicense the App, or use the App for any unlawful purpose.
The App displays ads through Google AdMob (banner, interstitial, and app-open ads). Some game modes are unlocked through one-time in-app purchases:
Purchases are processed by Google Play and are subject to Google's terms; entitlements are reconciled with Google Play. Except as required by law or Google Play policy, purchases are non-refundable.
The App, including all content, features, and software, is owned by Sia Makerlab and protected by applicable intellectual property laws. Any feedback you provide may be used by us without obligation to you.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that shot analyses or simulations are accurate, complete, or suitable for any purpose.
You are responsible for the photos and information you provide to the App. We are not responsible for any loss of data stored locally on your device.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIA MAKERLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, RESULTING FROM YOUR USE OF THE APP OR RELIANCE ON ANY ANALYSIS OR SIMULATION.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may suspend or terminate your access to the App at any time for conduct that violates these Terms. You may stop using the App at any time by uninstalling it.
We may update these Terms from time to time and will update the "Last Updated" date accordingly. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law provisions. For EU users, these Terms shall be interpreted in accordance with applicable EU law. Disputes shall be resolved through good-faith negotiation and, failing that, before the competent courts of the Republic of Korea.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sia Makerlab regarding the App.
